Large Number of RoHS Violations Reported in European Union
On July 1st, 2011, the European Union issued a directive in its Official Gazette, 2011/65/EU (RoHS 2.0), to extend product control to all electrical and electronic equipment. On June 4th, 2015, (EU) 2015/863 was issued and the RoHS 2.0 List of Restricted Substances was revised, with the addition of four new phthalate substances.
Since 2015, EU Member States have been continuously strengthening the inspection of RoHS compliance with electronic and electrical products in market enforcement activities. In the past two months, the EU rapid warning system for non-food consumer goods (RAPEX) has frequently notified RoHS violations, involving different types of electronic products such as communications, lighting, electronic accessories and electric toys, the vast majority of which are communicated from Swedish law enforcement agencies.
With such large number of recall cases recently, the EU could step up their effort for RoHS compliance checks in upcoming market enforcement. At the same time, enterprises should note that all electrical and electronic products (in addition to medical equipment and monitoring equipment) will have to meet the new requirements for four additional phthalates from July 22, 2019, when the four substances are likely to be subject to key verification by EU law enforcement agencies, advising companies to strengthen quality control to ensure that products comply with EU RoHS requirements.
