REACH, SVHC

REACH regulation, (EC) No. 1907/2006), has been established to promote the protection of human health and the environment from risks posed by chemicals, and to promote usage of alternative methods as substitutes of hazardous chemicals. It also aims to improve the availability and information exchange of chemicals used in manufacturing along the supply chain. According to Article 33 of REACH, producers and importers whose articles are imported to EU are required to fulfil their obligations of communication once any of their imported articles exceeds 0.1% Substance of Very High Concern (SVHC). Companies are required to provide sufficient SVHC information to recipient of the article in the industry. Upon request from consumers, companies are also required to provide the information regarding SVHC content within 45 days.

In 2018, the EU issued amendments to the Waste Framework Directive 2008/98/EC, stating that starting 2021, for any item containing any of the SVHC candidate substances with a concentration of >0.1%, the information should be submitted to ECHA. At the same time, ECHA is establishing a database to collect all SVHC information including the above mentioned. All manufacturers, importers and even consumers would have access to this database.

In lieu of growing concerns on communication obligations of SVHC, SGS is now offering Communication Document Preparation Service. The communication document will be prepared according to ECHA’s Guidance on requirements for substances in articles, and the document could be used to pass information down the supply chain and to downstream users. The communication document would include the following:

  • SVHC presence over 0.1% and its usage
  • Identification and Description of articles / components containing over 0.1% SVHC
  • Information of safe use that cover all relevant life cycle stages of the article
