APPLICATION OF DEIFFERENT VERSION OF <CODE OF DESIGN ON BUILDING FIRE PROTECTION AND PREVENTION>(GB50016)
As we well aware of, new version of <Code of Design on Building Fire Protection and Prevention> (GB50016-2014)came into force on 1st, May, 2015 already, however, in our opinion, the previous version 2006 could be still be applied during the audit practice, the reasons are as below:
1. In the part of General Principle of each version, it is clearly stated that this code shall be applicable to the construction, extension and renovation of the buildings (Article 1.0.2). That means when we conduct one audit now, if the exiting buildings were already completed before version 2014 came into force, version 2014 is not applicable.
2. After version 2006 came into force, Ministry of Public Security issued one internal notice (2007-68), in which it is stated that before the new version comes into force, if the fire safety design for buildings has been approved by Fire Dept. Of local government according to version 2001, the regulations in version of 2001 shall be referred to during the monitor inspections.And after version 2014 came into force, Ministry of Public Security issued another internal notice (2015-98) again, clearly stating that before the new version comes into force, if the fire safety design for buildings has been approved or registered by Fire Dept. of local government according to previous versions of code, the regulations in previous version which is valid when fire safety design is approved or registered shall be applicable. That means even now are invalid, the previous versions of code would still be referred by Fire Dept. when they conduct monitor inspection on exiting buildings, but not the new version.
3. During one audit, if only the new version of code is applied for all buildings, one paradox would be caused that the exiting building may not meet some requirements in the new version of code, but meet all requirements in the previous version when they were designed originally. Actually in the internal notice issued by Ministry of Public Security it is suggested that actions may be taken to ensure the buildings meet the new version of code, but it is not one mandatory requirement.
In short, in the social compliance audits, it is one reasonable practice to apply different version of code according to that when the buildings are designed.
