Article 33 of REACH Regulation (EC No 1907/2006) requires article suppliers to inform recipients in the supply chain if their article contains Substances of Very High Concern (SVHC) over 0.1% w/w. Upon the request of consumers, article suppliers have to provide SVHC safe use information within 45 days, free of charge.

The European Chemicals Agency (ECHA) published the first SVHC candidate list of 15 substances on October 28, 2008. The list is updated regularly in accordance with defined procedures and the next update will be in January 2010. ECHA’s Member State Committee unanimously agreed in early December 2009 that 15 new SVHC are to be included in the candidate list (see Table 1).

Since the announcement of the first SVHC candidate list, German and Swedish NGOs have conducted market research, asking European article suppliers of, for example children’s products and shoes, whether their products contain SVHC. Findings confirmed that some consumer products did contain SVHC. Moreover, the article suppliers are not always certain about their existence. It is true that not every SVHC is common in consumer products, and when referring to the 15 new SVHC, diisobutyl phthalate, tris (2-chloroethyl) phosphate and lead compounds are those most often present.
