Minimum wage is always one of the prevailing topics. Since January, 2016, minimum wage has been raised in 3 provinces and cities. In addition, there are updates on “Construction Project Environmental Impact Assessment Information Disclosure Mechanism”, “Construction Project Environmental Impact Assessment Information Disclosure Mechanism” and etc.
1. The minimum wage has been raised in three provinces.
Since January, 2016, the minimum wage has been raised in Chongqing, Jiangsu, and Liaoning. It should be noted that the 2013 minimum wage is still used in Liaoning province, which does not comply with the stated policy that minimum wage should at least be adjusted once every 2 years. 2. Rules of The Action Plan for Prevention and Treatment of Water Pollution will be announced this year: Poor pollution control will be accountable
Recently, news from Ministry of Environment indicated that they are in process of preparing assessment methods and details of implementation of “The Action Plan for Prevention and Treatment of Water Pollution”, which is expected to be issued within this year. It should be noted that accountability will be further elaborated and implemented. Ministry will sign the water pollution control objective responsibility statement with various provinces and cities. Local government will face strong accountability for ineffective governance.
3. Encourage public to complain and report food and drug violations
State Food and Drug Administration issued “Measures for the Administration of Food and Drug Complaint and Reporting”. The Measures implements reward system for violation reporting, encourages and supports public to complain and report food and drug violations. It is effective since 1 Mar 2016. The Measures clarified undertaking requirements and ensure result is transparent. Complaint handling department should investigate timely and take actions according to regulations. The result should be feedback within 60 days. For complex situation, the period could be postponed with approval. The postponement should not exceed 30 days generally.
4. Ministry of Environment: If the construction unit does not publish the EIA information, the EIA report will not be reviewed and approved.
The ministry recently issued a series of EIA institutional files. One file was “Constructive Project Environmental Impact Assessment Information Disclosure Mechanism” ( hereinafter referred to as the mechanism scheme), which clearly claimed to set up whole-process and full-coverage EIA information disclosure mechanism of constructive projects by the end of year 2016, guaranteeing the right of the public to know, to participate and to supervise the environmental impact of project construction. Requirement: 1) the EIA report of construction unit shall be open before approval; 2) The environmental protection department shall be open for reviewing and approving information of the EIA report; 3) The environmental protection department shall not review and approve the unpublished EIA report.
5. "Measures for Energy Conservation Supervision"was implemented since March 1st, 2016.
The measure stated that when the institutions under supervision violates energy conservation laws, rules, regulations and mandatory energy efficiency standards, the supervisory organization should issue a rectification notice with timeline. When the institutions under supervision could not meet the requirements by the timeline, the Energy Conservation organization will publish the relevant situations to the public and record them into the social credit system. If the institutions under supervision still violate energy conservation laws, rules, regulations and mandatory energy efficiency standards, the Energy Conservation organization will deliver the relevant clues to punishment of authorities to handle.
6. 10 national ministries and commissions jointly issued “Opinions on Strengthening Migrant Workers’ Pneumoconiosis Prevention and Treatment”
10 national ministries and commissions jointly issued “Opinions on Strengthening Migrant Workers’ Pneumoconiosis Prevention and Treatment” on Jan 20 2016. The Opinion defined the main responsibility of employers on dust monitoring, occupational protection, occupational health examination, etc. It requests all parts of the country to try best to diagnose pneumoconiosis disease of the migrant workers, to include related drugs into medical insurance, to include the pneumoconiosis of migrant workers into serious illness insurance and let these workers enjoy the low insurance supporting, etc.
