Under RoHS Directive 2002/95/EC, many electrical and electronic toys such as plush toys with flashing eyes or toy cars with flashing lights are not within the scope of RoHS as their primary function ‘play value’ is not dependent on electric currents or electromagnetic fields in order to function properly.
RoHS Recast Directive is currently replacing RoHS Directive in electrical and electronic toys. Under RoHS Recast Directive 2011/65/EU, the so-called RoHS II, ‘dependent’ has a new meaning and is defined as ‘needing electric currents or electromagnetic fields to fulfill at least one intended function’. As such, electrical and electronic toys such as those indicated above would need to be compliant with RoHS II.
