When the REACH Regulation (EC 1907/2006) entered into force in June 2007, it introduced the first legal EU obligation for substances contained in finished products. The legislation affects all parts of the supply chain that produce and use chemicals and export to Europe, and consequently, has created new challenges for the textile and footwear industries.

More than a year after its enforcement, a clear direction has emerged that the industry must focus on -- Substances of Very High Concern (SVHCs). The most immediate impact is to meet the obligation under Article 33 of the REACH regulation -- “Duty to communicate information on substances in articles.” If an article contains a substance on the Candidate List and the concentration of the substance is above 0.1% (corresponding to 1,000 ppm or 1,000 mg/kg) per article, EU suppliers of the article must provide sufficient information to their downstream users and upon request of any consumer within 45 days of receipt of the request. The information needs to include both the name of the substance as well as information on its safe usage. In addition, starting in 2011, if the total annual volume in all products is above 1 ton per year, manufacturers or importers have to notify the European Chemical Agency (ECHA).

To comply with these requirements, many industries, and in particular the textile and footwear sectors, are subjecting their products to analytical testing to determine if SVHCs are present, and if so, verify the concentration of SVHCs in the articles.
