In considering the comments from public consultation and the ECHA Member State Committee, 15 substances have been published on the ECHA website as the first SVHC candidate list. Cyclododecane is withdrawn because of the insufficient scientific evidence to justify as “Substances to be included in Annex XIV” (Article 57) of the REACH regulation.
By 1 June 2009, ECHA will submit these 15 substances to the European Commission for their agreement to be placed in Annex XIV (Authorization list). Unless obtaining authorization from the Commission, substances in the Authorization list cannot be manufactured or imported in the EU after a sunset date. Authorization aims to properly control the risks from SVHC and progressively replace SVHC to safer substances or technologies.
To protect human health and the environment, SVHC will further subject to “Notification of substances in articles” (Article 7) and “Duty to communicate information on substances in articles” (Article 33) under REACH. Notification to ECHA is required if any SVHC in the article is present at greater than 0.1% and the total amount exceeds 1 tonne per annum per producer or importer. Information in the Supply Chain is applied to those articles containing any SVHC above 0.1% (w/w).
